Terms of Service

Indicative data — no professional reliance. JS Site Viewer produces computer estimates from public NSW and Commonwealth datasets. Outputs are indicative only and are not a survey, valuation, planning certificate, engineering assessment or legal advice. You must independently verify every figure with the relevant council, a registered surveyor, a certifier and/or a suitably qualified planning professional before making any decision, offer, lodgement or expenditure.

1. Agreement

By accessing or using JS Site Viewer (the "Service") you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

The Service aggregates and visualises third-party government and open datasets for NSW property and development research. Data availability, accuracy, currency and completeness are outside our control and are provided "as is".

3. No warranty; limitation of liability

To the maximum extent permitted by law, the Service is provided without warranties of any kind. We do not warrant that outputs are accurate, current, complete or fit for any purpose. Nothing in these Terms excludes rights under the Australian Consumer Law that cannot lawfully be excluded. Subject to those non-excludable rights, we are not liable for any loss or damage arising from your use of, or reliance on, the Service, and our aggregate liability is limited to the fees you paid in the [3] months preceding the claim.

4. Acceptable use

You must not scrape, resell or redistribute the underlying data feeds, overload the Service or its upstream providers, attempt to bypass access controls, or use the Service unlawfully. Automated/bulk access is not permitted without written consent.

5. Accounts & subscriptions

Paid features require an account and a current subscription. Billing, renewal, cancellation and refund terms are described at checkout and in your account portal. [Billing/refund policy to be finalised.]

6. Third-party data & licences

Data is used under the licences listed on our Data & licences page (predominantly CC-BY 4.0 and ODbL 1.0). You must comply with those upstream licences.

7. Privacy

We handle personal information in accordance with our Privacy Policy.

8. Changes & governing law

We may update these Terms; continued use constitutes acceptance. These Terms are governed by the laws of New South Wales, Australia. [Jurisdiction/venue to be confirmed by legal review.]
